Subject however, to the following: 1. The terms and provisions, including the failure to comply of that certain Declaration of Protective Restrictions, Conditions and Reservations for Nanawale Estate Co. Unit 4, dated February 7, 1969, recorded February 12, 1969 in the Bureau of Conveyances of the State of Hawaii in Book 6405 Page 274. 2. Undated Declaration of Protective Restrictions, Conditions and Reservations for Unit No. 4 in Nanawale Estates, recorded in the Bureau of Conveyances of the State of Hawaii in Book 12774 on Page 193, on March 16, 1978. 3. The reservation in favor of the State of Hawaii of all mineral and metallic mines as reserved in Royal Patent No. 7788. 4. Reserving, however, unto Nanawale Estate Company, a California corporation, their respective heirs, successors and assigns, a perpetual easement, five(5) feet wide along both side lines and the entire rear line of said lots for the purpose of installing, constructing, inspecting, operating and replacing telephone, telegraph, electric light and power poles, wires, cables, lines and underground conduits, sewer pipes, gas and water pipes and other similar facilities and equipment; Provided, however, that any utility poles placed within the easement along the rear boundary of said lot(s) shall be placed at the corners of said lot(s) only, as reserved in that certain Deed dated February 20, 1969, recorded on August 25, 1069 in said Bureau of Conveyances in Book 6653, Page 222.
