All of that certain parcel of land situated at Keaau, in the District of Puna, Island and County of Hawaii, State of Hawaii, described as follows:

Lot No. 880, Block 6, of Unit III, containing an area of 20,000 square feet, and being a portion of the property shown on Map 12, filed in the office of the Assistant Registrar of the Land Court Application No. 1053, amended and described in Transfer Certificate of Title No. 230,391, issued to Roger Dean Griswold and later amended and described in Order and Judgement Approving Final Count, Distribution of Estate and Discharge of Personal Representative: Case# 05-1-0268, recorded November 21, 2006 in the Office of Assistant Registrar in the State of Hawaii.

Together with an easement over, under, across, along and upon all streets, roads and avenues (herein called “roadway”) described and mentioned in said Transfer of Certificate of Title No. 126,843 to be used in common with, and subject to the similar rights of others entitled thereto for roadway purposes.

Together with an easement across Lot 8873, as shown on Map 220 of said Land Court Application, to be used in common with others entitled thereto.

Subject to:

1. The reservation of the power to Mauna Loa Estates, Inc., a Hawaii corporation, its successors and assigns, to convey any of said roadways owned by them to appropriate governmental authority or to the Mauna Loa Estates Community Association, or similar organization, for use as public roadways, or to convey undivided interests therein to the owners of all lots requiring or for whom it would be convenient to have access over the same, and upon any such conveyance said easement over the roadways conveyed shall terminate.

2. The restrictive covenants and conditions relative to the use of the property set forth in the Declaration of Covenants, Conditions and Restrictions filed in said Office as Land Court Document No. 4787C7, and noted on said Transfer Certificate of Title No. 126,843.

Said land is under the operation and provisions of Chapter 501 of the Hawaii Revised Statutes, and that the title to said land is registered under said Chapter, subject however, to any of the encumbrances mentioned in Section 501-82 of said Hawaii Revised Statutes which may be subsisting, and subject also to all other encumbrances of record.
